Terms of Service

These terms govern access to and use of the Loomis platform. By creating an account or using the platform you agree to them.
1. Who we are
Loomis ("Loomis", "we", "us") operates the platform available at loomis.co.za. You can reach us at hello@loomis.co.za.
2. The service
Loomis transforms publicly available digital information into structured, evidence-backed behavioural assessments. Assessments are informational: they organise and explain evidence so that a person can make a better decision. Loomis does not make decisions, does not determine suitability for employment or any other role, and does not draw legal conclusions of any kind.
Assessments about someone else are composed only of lawfully accessible, publicly available information — Loomis never accesses a private account, private messages, or any other source behind authentication to build them. Where you connect your own account — or, on Loomis Guard, a household member connects their own account — that connection is authorised directly with the platform and can include content that is not publicly visible, other than direct messages, which Loomis never reads.
3. Accounts and eligibility
Access to Loomis is currently by invitation. You must provide accurate account information, keep your credentials secure, and be authorised to act for the organisation on whose behalf you use the platform. You are responsible for activity under your account.
4. Acceptable use
You may use Loomis only for the legitimate purposes you select when creating an assessment, and only where you have a lawful basis to assess the person concerned under the laws that apply to you (including, where applicable, the Protection of Personal Information Act, 2013 and employment law).
- Do not use Loomis to harass, stalk, discriminate against, or intimidate any person.
- Do not use an assessment as the sole basis for an adverse decision about a person — assessments inform human judgement; they do not replace it.
- Do not attempt to assess a person outside a legitimate purpose, or misrepresent your purpose when creating an assessment.
- Do not resell, scrape, reverse-engineer, or misuse the platform or its reports.
5. Payments and credits
Assessments are paid for per assessment. Each purpose you select is a credit-priced line item; the total price in your checkout currency is shown before you pay. Payments are processed by third-party payment providers; Loomis never receives or stores your card details.
The price shown at checkout is locked to that assessment. A later change to our pricing never changes what you agreed to pay.
Loomis Solo, Creator and Guard are subscriptions: you are billed on a recurring basis at the tier's current price until you cancel. A subscription renews automatically each billing period; cancelling stops future renewal but does not refund the period already paid for. If a renewal payment fails, Loomis gives you a period to fix it before access is restricted and, if it remains unresolved, the subscription is cancelled.
6. Refunds
If we cannot complete an assessment you have paid for, we will re-run it or refund the payment for that assessment. Refund requests should reach us within 14 days of payment. Because an assessment consumes third-party collection and analysis the moment it runs, completed assessments are not refundable.
This applies to one-off assessments. Subscription cancellation and its billing treatment are described above, under Payments and credits.
7. Intellectual property
The platform, its reports, and all software, designs and content are and remain the property of Loomis or its licensors. Reports are licensed to you for your organisation's internal decision-making, not for republication or resale.
8. Disclaimers
Public information is incomplete and changes constantly. Loomis provides assessments on an as-is basis and does not warrant that an assessment is complete, that every finding is free of error, or that the absence of findings means the absence of risk. You remain responsible for the decisions you make.
9. Liability
To the maximum extent permitted by law, Loomis's total liability arising out of or related to the service is limited to the amount you paid for the assessment giving rise to the claim. Loomis is not liable for indirect, consequential or special damages, or for decisions you take based on an assessment.
10. Suspension and termination
We may suspend or terminate access for breach of these terms, unlawful use, or abuse of the platform. You may stop using the platform at any time; provisions that by their nature survive termination (including payment obligations, disclaimers and liability limits) survive.
11. Governing law
These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction over any dispute arising from them.
12. Changes to these terms
We may update these terms from time to time. The date at the top of this page reflects the latest revision; material changes will be communicated to account holders before they take effect.
